Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Agent P application and related website (the “Service”), operated by 3P Productions, LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Agent P is a voice-led diagnostic instrument (the “AI Transformation Internal Risk Assessment™”) that guides a participant through a spoken or typed assessment of twelve questions across three pillars (Culture, Mindset, and Skills), scores the responses, and provides results and a personalized report. The Service and its results are provided for informational and educational purposes only.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Intellectual Property

The Service, including the “AI Transformation Internal Risk Assessment™,” its questions, scoring methodology, reporting tiers, content, design, and all related materials, is the intellectual property of Dr. Jennifer Posa and/or 3P Productions, LLC and is protected by applicable law. Except as expressly permitted, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Service without our prior written consent.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems.
• Reverse engineer, scrape, or harvest data from the Service except as permitted by law.
• Submit false information or impersonate another person.
• Use the Service to develop a competing product or to misappropriate its methodology.

5. Your Content and Submissions

You retain ownership of the information you submit. By submitting responses and contact information, you grant us a limited license to use that information to operate the Service and provide your result, as described in the Privacy Policy. You are responsible for the accuracy of the information you provide.

6. No Professional Advice; Informational Result

The assessment result, score, tier, and report are informational and do not constitute professional, legal, financial, medical, psychological, or other advice, and should not be relied upon as such. You are solely responsible for any decisions you make based on the result. We make no representation that the result is suitable for any particular purpose.

7. Third-Party Services

The Service relies on third-party providers (including voice, hosting, database, AI, and email providers) and may link to third-party sites. We are not responsible for the availability, content, or practices of third parties, and your use of them may be subject to their own terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3P PRODUCTIONS, LLC AND ITS AFFILIATES, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless 3P Productions, LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located in Ocean County, and you consent to their jurisdiction.

13. Changes to These Terms

We may modify these Terms from time to time. Material changes will be posted with a revised “Last updated” date, and your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
